Terms
The deal, written down
Short version: the report and the mock are free and put you under no obligation. If you buy, the site becomes yours once the build fee has cleared, the build fee is refundable for fifteen days, and the monthly plan is paid a month ahead and can be left at any time, in one press, from your account. The rest of this page is those sentences with their edges filled in. If you sign the hosting and maintenance agreement, that agreement is the full deal, and it decides if it and this page ever differ.
In force from October 11, 2026.
Who you are dealing with
Kirrby Studio is run by Iconoclasties LLC, PO Box 90056, Brooklyn, New York 11209. These terms, and anything that happens under them, are governed by the law of the State of New York.
Using this site, asking for the free report or the free mock, or buying anything here means you are agreeing to what is on this page.
The free report and the free mock
Both are free, need no card, and put you under no obligation. The report is Kirrby Studio's honest read of your public pages on the day they were read. It is Kirrby Studio's own way of measuring, not an industry certificate, and not a promise about rankings, traffic or sales. What you do with it is your call, and Kirrby Studio never touches, signs into or changes the site you already have.
The mock lives at a Kirrby address and stays Kirrby Studio's property unless you buy. Walk away and nothing is owed and nothing needs cancelling; Kirrby Studio may take the mock down after a while.
The build
The build starts with one conversation, then takes up to thirty days from your payment, with back and forth to get it right and a check-in about once a week. Your site goes live on your own domain when you approve it, and it waits for you until then.
You get up to three major revisions. A major revision changes how the site works: which pages there are, how it is laid out, where the menu lives. Swapping words and pictures is finishing, and is not counted. Each major revision is confirmed by email as it is used.
If Kirrby Studio is waiting on your content, answers or access, you are emailed and told what is needed, and the thirty days keep running. After sixty days of silence there is one more email; if there is still no reply, the build closes, and starting it again is a new build fee at the price then current.
Buying, and who owns what
Once your build fee has cleared, the finished site is yours: your pages, the words and images made for you, and the design as it was delivered and later changed for you. Those rights stay yours even if something later goes wrong with a payment. Kirrby Studio connects the site to your domain and hands it over.
Two carve-outs, both ordinary. Third-party pieces such as fonts, plugins and stock imagery stay under their own licences rather than becoming yours to pass on. And the underlying layouts, templates and tooling stay Kirrby Studio's, because they get reused; as the survey says when you start, a reused design is always stripped of your name, your branding and your details first.
Some of those standard elements are built into your site's files. You get a permanent, free licence to use, copy and change them as part of your site, including after you leave, and to let whoever hosts or looks after your site do the same. You cannot sell them to anyone on their own.
Some images or copy may be made with AI tools. They can be wrong, and can produce something close to material made for someone else, so check before you publish. Under current US copyright law, material made purely by AI may not be protected by copyright, so Kirrby Studio cannot promise it is exclusive to you. What is on your site is your responsibility, and approving something for publication, or publishing it yourself, is how that responsibility passes to you.
The refund on the build fee
The build fee is refundable in full for fifteen days, counted from the day you pay it. After those fifteen days it is not refundable. If you take the refund, the build stops, the plan never starts, and the work done so far stays with Kirrby Studio.
The monthly plan
Your monthly fee starts when the site goes live, or at the end of the thirty-day build window, whichever comes first. If the build is not finished by then because of Kirrby Studio, the fee waits until your site is ready.
It is paid a month ahead, on the day of the month it started. If it starts on March 10, that payment covers March 10 to April 9. There are no late fees and no interest. A payment that is reversed or charged back counts as a missed payment.
If you are not on a founder price, your price may change. You are emailed at least five business days, and no more than thirty days, before a new price applies. You can leave at any time, and if you leave within fourteen days after your first payment at the new price, the unused part of that month is refunded.
A founder price never goes up for as long as you stay, and founders get 25% off anything else the studio releases while they are a client. It ends if you leave, including when a plan ends after missed payments, and it does not come back with you.
If a payment is missed
The timing runs from the day the payment was missed. Kirrby Studio emails you, and your site stays up for one month while the missed payment gets paid.
If it is still unpaid after that month, you are emailed again and the site is temporarily taken down. Visitors see a plain page saying the site is temporarily unavailable, and nothing more. Everything is kept.
If it is still unpaid after a further month, your plan ends. Kirrby Studio sends you your site's files, your words and images and everything you have saved, without you needing to ask, and keeps your files and data for the period set out under Leaving. You are welcome back at any time while the files are held: pay the months you missed and the site goes back up. The only amount owed is the missed monthly fees, and your files are never held back to make you pay.
Leaving
You can leave whenever you want, from your account, online, in one press, with no call and no email. It takes effect the moment you press it: your plan ends and no further monthly payments are taken. You choose how hosting ends: at the end of the month you have already paid for, or one month after that if you would like the site to stay up while you move it, which you pay for when you choose it. Nothing is owed for leaving. There is no minimum term, no notice period and no exit fee.
On or before your site's last day, or within seven days of leaving if that is sooner, Kirrby Studio sends you your site's files including the design, your words and images including the generated ones, everything saved in your back end, a copy of your data such as form messages, a plain note on what the files need to run, and a list of whose each item is. Your domain was always yours.
Files are not a running website. You will need hosting of your own and someone technical to set them up. The hosting, your back end, the AI tools, the studio's apps, the sit-downs and seasonal changes, and the looking-after stop when you leave. Kirrby Studio removes its access to your accounts within seven days and confirms by email. If you die, or the business closes, whoever can show they are entitled to act for it can ask for the same files.
Kirrby Studio keeps your files and data for twelve months after your plan ends, as a courtesy, so you can ask for another copy or come back. Then you are emailed, and they are deleted thirty days later unless you ask for them. You can ask for deletion sooner, or for a copy, at any time. The record of what you accepted is kept separately, for as long as you are a client and six years after.

Keep your details accurate and your sign-in to yourself.
When Kirrby Studio can take a site down or end the service
A site can be taken down straight away only if it is being used for something unlawful, a court or an authority requires it, or someone's copyright is being infringed. You are told why, and the site is put back as soon as the problem is fixed. Taking a site down this way does not end the agreement.
Kirrby Studio can end the agreement only if it closes its hosting service for every client, with at least sixty days' notice by email; or if your site is used to mislead or harm the people who visit it, something you supplied infringes someone else's rights and you do not remove it when asked, or you threaten or abuse Kirrby Studio in writing or keep contacting it after being asked to stop. Being angry or blunt does not count. For the last three, you are emailed first and have fourteen days to put it right, and your site stays up meanwhile. In every case you get everything described under Leaving, and a refund for any month you have paid for and will not use.
What Kirrby Studio is on the hook for
Doing the work this site describes, with care. Kirrby Studio aims to keep your site up all the time, but nobody can guarantee a site is never down. Not promised, because nobody can honestly promise them: search rankings, visitor numbers, enquiries, customers, revenue, or what any third party's platform decides to do.
Kirrby Studio is one person. When time away is known in advance, you are told before it starts, and reply times count from the return. Neither side is responsible for delays caused by things outside their control, like a major outage, a natural disaster or a serious illness. If that lasts more than thirty days, you can leave and take everything described under Leaving.
To the extent the law allows it, Kirrby Studio's total liability to you is capped at what you paid Kirrby Studio in the twelve months before the claim, and neither side is liable for lost profits, lost revenue, lost data or other indirect losses. These limits do not apply to fraud, willful misconduct, gross negligence, or anything the law does not allow to be limited.
If your data may have been exposed, you are told as soon as it is known, with what happened and what is being done, and given what you need to tell your own customers.
When these terms change
The date at the top is the version you are reading. If a change affects what you get, what you pay or your rights, account holders are emailed at least five business days, and no more than thirty days, before it applies, with what changed. If you do not want to continue, you can leave before it applies and take everything described under Leaving. A change can never raise a founder price, add late fees, or take away anything you have already paid for.
